Employment Protections for the Guard and Reserve

The federal law that establishes the employment rights and responsibilities of members of the National Guard and Reserve − and their employers − is called the Uniformed Services Employment and Reemployment Rights Act (USERRA). We are very familiar with this law and regulations put forth by the U.S. Department of Labor.

The law applies to all types of employers, and requires them to allow participation in military service. This does not only cover an employee's ongoing duty to participate in military training one or two days a month. It also includes reinstatement to an employee's previous job following a deployment in the Armed Forces, as well as safeguards for seniority, benefits, and any necessary retraining.
