Pregnancy & Disability Discrimination
Reasonable Accommodations for Pregnancy and Disability
New York & New Jersey Disability Discrimination Attorneys
In 1990, the Americans with Disabilities Act (ADA) was created to eliminate barriers to employment for people with disabilities. American businesses are still trying to reach that goal: some are not trying very hard.
The disability discrimination lawyers at Zatuchni & Associates provide legal services to workers who have suffered discrimination, even injury, because an employer refused to make adequate accommodations in the workplace.
Our goal is to help you find financial recovery and justice through the legal system. Contact our office to speak to a New York or New Jersey disability discrimination attorney.
What is a Disability?
The ADA requires employers to make accommodations for a wide range of disabilities including mental and in some cases emotional disabilities, serious illnesses like cancer, short-term physical disabilities like those covered by workers’ compensation, and pregnancy. If you have a question about what constitutes a disability, you can find information on the ADA Web site.
Failure to Make Reasonable Accommodations
Employers are required to make reasonable accommodations, but “reasonable” is open to interpretation. If you believe your employer did not make a reasonable effort to accommodate your disability after you requested an accommodation, talk to a disability discrimination attorney to get a professional opinion about how the courts have ruled in cases similar to yours. (Watch our firm newsletters for updated information.)
Disability discrimination lawsuits have covered requests for accommodation for:
- a shorter work week or different work hours
- time off to go to medical appointments
- adaptive equipment to make job duties possible or to prevent aggravating existing injuries
- adaptation of job duties or procedures
Pregnancy & Serious Illness Discrimination
Pregnant women are protected by the Pregnancy Discrimination Act, and pregnant women and persons with serious illness are covered by the Family and Medical Leave Act. You have a right to return for a certain time to your employer, although not always to the same job. If you’ve come back from leave only to find yourself unemployed, you may be eligible for back pay, front pay, and damages. Talk to a disability discrimination attorney at Zatuchni & Associates to understand your rights under the law.
